Merchel Stolarka online shop — terms and conditions

Governing language. These terms are a translation of the Polish original. In the event of any discrepancy between the language versions, the Polish version prevails. The contract of sale is concluded under Polish law.


§ 1. Who runs the shop

The online shop at merchelstolarka.pl is operated by:

The Seller is a registered VAT payer.

§ 2. What the shop sells

The shop sells wooden sauna accessories made in the Seller's workshop. Products are made from solid timber; given the natural character of the material, grain pattern, shade and small differences in figure are a property of the product, not a defect.

Product photographs show the actual item. On-screen colour may differ from reality depending on display settings.

§ 3. Who may buy

An order may be placed by an adult with full legal capacity, and by a business. Provisions concerning consumers apply accordingly to a sole trader benefiting from consumer protection under art. 385(5) of the Polish Civil Code.

No account is required to place an order.

§ 4. How to place an order

The shop has no basket and no online payment. You place an order through the form on the website, by email, or via WhatsApp at +48 604 605 976.

  1. Choose the product and go to the contact form, selecting the scope "Shop order". You can also write directly to kontakt@merchelstolarka.pl.
  2. Give the item name and quantity, the delivery address, and invoice details if you need one.
  3. Accept these terms — this is a condition of placing an order.
  4. The Seller replies with a confirmation listing the products, prices, delivery cost, the total amount due and the bank details for the transfer.

The contract of sale is concluded when you confirm that order — by replying to the Seller's message or by paying it. Until then the enquiry creates no obligation on either side.

§ 5. Prices and payment

All prices shown in the shop are gross prices and include VAT at 23%. The price does not include delivery, which is shown before you place the order.

Payment by bank transfer to the Seller's account, given in the order confirmation. The shop does not accept card payments and does not use an online payment provider, so payment card data is never collected in this shop at all.

Orders are fulfilled once the payment has been credited.

An invoice is issued on request — say so in your order and provide your VAT ID.

§ 6. Delivery

Shipping is available within the territory of the Republic of Poland only.

Delivery cost: PLN 19 per order, regardless of the number of products.

Orders are dispatched within 5 working days of payment being credited. Where a product is temporarily out of stock and made to order, the lead time is stated in the order confirmation.

The Seller notifies you by email when the parcel is dispatched.

§ 7. Right of withdrawal

If you are a consumer, you may withdraw from the contract within 14 days of the day on which you took possession of the product, without giving a reason.

To withdraw, send a statement to kontakt@merchelstolarka.pl or use the form on the website. You may use the model form annexed to the Polish Consumer Rights Act, but this is not required.

You return the product at your own cost to the Seller's address within 14 days of making the statement. The Seller refunds the payment received, including the cost of the cheapest delivery offered, within 14 days of receiving the statement — and may withhold the refund until the product is received.

The right of withdrawal does not apply to a product made to the consumer's specification or clearly personalised — art. 38(3) of the Consumer Rights Act. This applies to personalised products, for example a sign with custom lettering. For such products, the absence of the right of withdrawal is stated in the description before purchase.

§ 8. Complaints

The Seller is liable for the conformity of the product with the contract on the terms set out in the Consumer Rights Act.

Send complaints to kontakt@merchelstolarka.pl. Describe the non-conformity and attach photographs. The Seller considers a complaint within 14 days of receiving it.

Under a complaint you may request repair or replacement. If repair or replacement is impossible or would involve excessive cost, you may request a price reduction or withdraw from the contract.

§ 9. Natural properties of timber

The following are not defects and are not grounds for complaint:

§ 10. Out-of-court dispute resolution

A consumer may use out-of-court complaint and redress procedures, including mediation at the regional inspectorates of the Trade Inspection and the assistance of the district consumer ombudsman.

Using these routes is voluntary and requires the consent of both parties.

§ 11. Personal data

Data processing is described in the Privacy policy available on the shop website.

§ 12. Changes to the terms

The Seller may change these terms for important reasons, in particular a change of law or of the scope of services provided. Orders placed before a change are governed by the terms in force at the time the order was placed.

The Seller announces any change on the shop website 14 days in advance.

§ 13. Final provisions

Matters not regulated here are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.

These terms are available free of charge on the shop website in a form allowing them to be downloaded, saved and printed.
